Non-Interactive Webcasting
This licence allows the webcaster to copy AVLA members' sound
recordings onto servers located in Canada and transmit these copies
to permitted devices of end users in Canada.
Some terms of this licence include:
- This licence is valid for six (6) months.
- The territory of the Agreement is Canada and no sound
recordings or ephemeral copies of sound recordings may be made or
transmitted outside the Territory.
- The webcaster may not permit any interactive transmissions;
i.e., transmissions where the end user can specifically select
sound recordings to be transmitted in a play list ahead of
time. The webcaster will not cause any device receiving the
transmission to switch from one program channel to another, and
shall not include any skip, pause or back buttons or any
functionality that allows the end users to personalize the
service.
- The webcaster will not transmit more than four sound recordings
from any one artist during any 3 hour period, or more than three
sound recordings from any one album including no more than two
consecutively.
- AVLA and the record companies are not obligated to provide you
with source music.
- The webcaster is required to stream music at equal or higher
quality as intended by the record company.
Fee:
Refundable, Non-Interest Bearing Security deposit: $7,500.00
License Fee: two cents ($0.02) per ephemeral reproduction made and
the greater of $0.001 for each transmission of each sound
recording, or $0.65 per subscriber per month, or 15% of gross
revenues pro-rated to the market share controlled by AVLA members
participating in the webcasting agreement, plus applicable G.S.T.
or H.S.T.
