Leasing Music Supply Service Product

If you are leasing CD's, DVD's or VCD's from an AVLA licensed
Music Supply Service or Video Pool Service, you can be assured that
the product you have leased has been legally produced and meets or
exceeds industry standard.
We wish to draw your attention to some of the conditions imposed
upon your lease of this product. When you obtained the product, you
signed a lease agreement that contains an acknowledgement. Items 1
and 2 of this acknowledgement state:
- Recorded musical compositions embodied on Analogue
Programs/Digital Programs Leased from «COMPANY» are not to be
duplicated, sold or otherwise distributed, pledged, mortgaged or in
any other way encumbered.
- The copyright in the recorded musical compositions embodied on
Analogue Programs/Digital Programs Leased from «COMPANY» are the
property of AVLA member Record Companies.
This means that if you decide you no longer wish to operate a
commercial business offering sound recordings or music videos as
entertainment to the public, you may not sell or otherwise
dispose of the programs that you have leased to any party under any
circumstance, except an approved assignment of the
lease.
It is clearly stated on the packaging as well as the face of
each CD, VCD or DVD that you lease from an AVLA licensed Music
Supply Service or Video Pool Service that the product is:
"For restricted use only. Subject to
Recall. NOT FOR SALE. *Music Videos/Sound Recordings licensed by
AVLA are the property of record companies (the owners of
copyright), all rights reserved. If you purchased this [compact
disc, cartridge, cassette or other contrivance] call
1-800-668-8820."
If you breach the acknowledgement you signed by duplicating,
selling, or otherwise disposing of product you have leased, the
Music Supply Service or Video Pool Service is obligated, under the
terms of their Agreement with AVLA, to recall the product and any
copies from you. You will be liable for infringement of copyright
in the sound recordings or music videos and may be subject to civil
or criminal penalties under the provisions in the Copyright
Act.

Supply/Video Pool Service.
Understanding Your Schedule B
- When you subscribe to a Music Supply Service, it is important
to understand that you do not own the CDs - you are renting them.
The CDs are still the property of the Music Supply Service and you
do not have the right to copy, sell, rent, give away or lend these
CDs. If you copy, sell, rent, give away or lend these CDs, your
subscriber agreement will be terminated and you will have to return
all CDs, at your expense, to the Music Supply Service.
- The sound recordings on a Music Supply Service CD are owned by
the record companies.
You may only keep the CDs as long as the Music Supply Service is
licensed by AVLA. If the Music Supply Service is no longer licensed
by AVLA, you will receive a written notice and must return all the
CDs you have rented to the Music Supply Service or to AVLA.
- Each CD you rent from a Music Supply Service will have its own
unique serial number and the AVLA warning on the CD and on the
packaging as follows:
